1. Who we are
PoolHealth (“the Service”) is a web app for pool specialists, pool businesses, pool owners and their clients. It is provided by PBG POOLHEALTH LTD, a company registered in Cyprus (registration no. HE 497335), Georgiou Karaiskaki 7, 8560 Pegeia, Paphos, Cyprus (“we”, “us”). Contact: info@pool-health.com.
These Terms apply together with our Privacy Policy and, for Owner, Specialist and Business accounts, our Data Processing Agreement, which covers the personal data of other people that you enter. You accept them when you create an account; we record which version you accepted and when. If we change them, section 13 applies. If you do not agree, please do not use the Service.
2. Accounts
The Service has several kinds of account: Client (free, created by your pool specialist), Owner (you look after your own pool), Specialist, Business (a company with a team), and team members of a Business (specialists and office managers).
- You must be at least 18 years old and give correct information.
- Keep your password secret. You are responsible for what happens under your account.
- Client accounts are for adults only. A specialist or business that creates a client account confirms that the client is an adult, agreed to have the account and was told how their data is used.
- Specialist and Business accounts: by buying one of these plans, you confirm that you hold the certification or qualifications required for this work where you operate. PoolHealth gives calculations and recommendations as decision-support tools and relies on a qualified person to check the readings, choose the products and decide what to do. We do not check qualifications, licences or insurance.
- The holder of a Business account decides who joins the team and what they can see, and is responsible for removing access when someone leaves.
3. Plans, prices, trial and payment
All prices are in euros and exclude VAT. VAT is added at the rate that applies: currently 19% Cyprus VAT. The payment screen shows the total including VAT before you pay. If you are a business in another EU country and give a valid VAT number at checkout, the EU reverse charge applies: your invoice shows no VAT and you account for the VAT yourself. Current plans: Owner €36 + VAT per month (€42.84 including 19% Cyprus VAT; up to 2 pools); Basic professional €49 + VAT per month (up to 30 pools, one login); Business basic €99 + VAT per month (up to 100 pools, 2 specialists and an office manager).
- Add-ons (Recommendations, Customisation, Adverts) for Basic professional and Business: €15 + VAT per month each.
- Extra pools: €1 + VAT per pool per month above the plan's pool limit.
- Business only: an extra specialist costs €25 + VAT per month and adds one specialist login and 50 pools; a pool pack costs €25 + VAT per month and adds 50 pools without a login.
- Paying yearly: you pay for 10 months and get 12 (“2 months free”).
New accounts start with a free 14-day trial with all add-ons included. No card is needed and nothing is charged automatically: when the trial ends, the paid features become read-only until you choose a plan and pay.
Before you pay, the payment screen shows the total price including VAT, the billing period, that the subscription renews automatically and how to cancel it. The paid subscription starts when you press the button to subscribe and pay and the payment is confirmed. Payments are handled by Stripe; we never see or store your full card number.
Subscriptions are billed in advance for each month or year and renew automatically at the end of each period, charged to the same card, until you cancel. For yearly subscriptions we e-mail you a reminder at least 7 days before each renewal with the amount and how to cancel. It goes to the e-mail address of your account, so please keep it up to date; if an e-mail cannot be delivered we cannot send it, and your right to cancel does not depend on it. You can cancel at any time in My profile → Plan → Manage subscription; the plan then stays active until the end of the period already paid for.
If you change your plan or add-ons during a billing period, the price difference for the rest of the period is charged or credited by Stripe (a credit is used against your next payments), as shown before you confirm the change. Plan limits (number of pools and team members) are enforced: you cannot save more than your plan and the extra pools, specialists or pool packs you pay for allow — each paid extra raises the limit accordingly, and the new limit and price are shown before you confirm — and you cannot reduce a plan below what you already use.
Price changes: we tell you by e-mail at least 30 days before a higher price applies to your next renewal, and you can cancel before it does. A price change applies only to future renewals and does not change what you have already paid for the current period. Where the law requires your consent to a change, we ask for it.
If a payment fails, access to paid features may be limited until it is resolved. Your data stays stored while you sort out the payment.
4. Right of withdrawal, cancelling and refunds
If you are a consumer (a person acting for purposes outside your trade, business or profession), you may withdraw from a paid subscription within 14 days of the day it starts, without giving any reason. We then refund every payment made for that subscription in full, without undue delay and at the latest within 14 days of receiving your withdrawal, to the same card (it usually arrives within 5–10 business days). Your data is kept.
- How to withdraw: send us a clear statement — for example an e-mail to info@pool-health.com with your name, the plan and the date you paid — or use the model withdrawal form at the end of these Terms. Instructions and a form to fill in are also on our website, in the documentation (Right of withdrawal page). You keep the deadline if you send the statement before the 14 days end.
- We confirm every withdrawal by e-mail with your statement and the date and time we received it, and cancel the subscription at once.
After you subscribe, we send you a confirmation of the contract by e-mail: the plan, price including VAT, billing period, renewal and how to cancel, information on the right of withdrawal with the model withdrawal form, and these Terms, the Privacy Policy and the Data Processing Agreement attached as a file you can keep.
The Basic professional and Business plans are intended for use in a trade or profession. When subscribing, you must accurately state whether you are acting for business purposes. Your legal status as a consumer is determined by the applicable law and the circumstances of your purchase, not solely by the plan you select. If you qualify as a consumer, your mandatory statutory rights remain unaffected; write to info@pool-health.com and we deal with your request (for example a withdrawal) by hand: we confirm receipt by e-mail and, where a refund is due, make it without undue delay and within 14 days.
Outside the right of withdrawal, we do not refund a period already started or unused time, except where the law requires it. Nothing in these Terms limits any mandatory consumer rights you have where you live.
5. Your data and content
You own the data and content you put into the Service (clients, pools, readings, photos, messages, documents). You give us the right to store, process, back up and display it only as needed to provide, secure and support the Service for you and as you instruct us through the Service.
You can download your data at any time in My profile (what the file contains is listed in the Data Processing Agreement, section 9). When you enter information about other people (for example your clients, guests, staff or contractors), our processing of it is governed by the Data Processing Agreement, and you are responsible for having a lawful basis to enter it and for telling those people about it.
6. Acceptable use
Do not use the Service to break the law, to harm or deceive others, to send spam, to impersonate anyone, to collect other people's data without a reason, to attack or overload the Service, or to copy or reverse-engineer it.
If we restrict an account or switch off a public page because of a suspected breach, we tell the account holder the reason (unless the law forbids it), and they can reply or object at info@pool-health.com; we review the decision and restore access if the suspicion was unfounded. In urgent cases (safety, unlawful content, an attack) we may act first and inform afterwards.
7. Pool calculations and chemical safety
PoolHealth provides calculations, indicators and recommendations as decision-support tools based on the information entered by users. Results depend on the accuracy, completeness and units of the input data, the assumptions used by the relevant calculation and the characteristics of the products being used.
PoolHealth does not independently verify water measurements or inspect the physical condition of a pool. Results are not a substitute for appropriate testing equipment, verification of measurements, product instructions, applicable safety requirements or professional judgement.
Chemical and water-balance calculations in PoolHealth are based on established formulas and typical pool conditions. They give averaged estimates, not exact values, because real pool water depends on many factors that no calculation can fully take into account, including temperature, water source and mineral content, other chemicals already present, stabiliser (cyanuric acid) and salt levels, product purity and age, mixing and circulation, sunlight, bather load, and the accuracy of the test kit used. Calculations that estimate pH, total alkalinity, sulphates, calcium or the effect of products not covered by the standard settings are approximate in particular. We review and may improve the formulas from time to time, but we do not promise that a result will match the actual water. Always dose in steps, retest after each dose and let your own measurements and professional judgement decide. If results are unusual or unexpected, check the readings and consult a qualified pool specialist.
Before acting on a result, users must verify the measurements, units, product concentration, applicable dosage instructions and relevant safety precautions. Never mix pool chemicals unless the product instructions expressly permit it. Follow the manufacturer's instructions for handling, storage, dosing and retesting.
The app shows which entered values each result is based on, checks readings against accepted ranges, points out likely unit mix-ups, splits large doses into portions and flags a free chlorine above 6 ppm for checking. These warnings and other safeguards are intended to reduce certain risks but cannot guarantee that every incorrect input, unsafe condition or erroneous result will be detected.
PoolHealth does not guarantee a particular water condition, treatment outcome or absence of damage. Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.
8. Public pages and directory
With the Adverts add-on a specialist or business can publish a public page and appear in the specialist directory. The account holder writes the page and is responsible for keeping it accurate, lawful and up to date, including any statements about qualifications, licences or insurance.
We do not check specialists' qualifications, licences, insurance or the quality of their work, and we do not guarantee their results. Enquiries sent through a page go to that specialist or business; we are not a party to any agreement between them and the person who contacts them.
Anyone can report a page they believe contains illegal content or breaks these Terms with the “Report this page” form on every public page (or at info@pool-health.com). The form asks for the reason, an explanation, where exactly the content is on the page, the reporter's name and e-mail, and a statement that the report is made in good faith. We confirm receipt by e-mail with a report number, review each report diligently, objectively and without undue delay, and tell the reporter our decision. If we remove or restrict a page or part of it, we send the account holder a statement of reasons by e-mail: which content and what measure (for example removal, or switching the page off) and for how long; the facts and circumstances we relied on, including whether the decision followed a report; the provision of these Terms or of the law that the content breaches, and why; whether automated means were used (we do not use them for these decisions); and how to contest the decision: by replying to us (we review it again), through an out-of-court dispute settlement body certified under the EU Digital Services Act, or in court.
9. Availability and changes to the Service
We work to keep the Service available and your data safe, but we do not promise it will always be uninterrupted or error-free. We may improve, change or remove features. If a change seriously affects you, we tell you in the app or by e-mail.
If we stop offering the Service, or a feature that holds your data, we tell you at least 30 days in advance so you can download your data, and refund any prepaid fees for the period after it stops.
10. Our rights
The Service, its design, name and software belong to us or our licensors. You get a limited, non-exclusive, non-transferable right to use it while your account is active. We claim no ownership of your content.
11. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, for intentional or grossly negligent conduct where the law does not allow a limit, under data-protection law to the extent it is mandatory, and your statutory rights as a consumer (including those about the conformity of digital services).
If you are a consumer, we are liable under the applicable law for damage caused by our breach of these Terms or of the law, but not for loss that was not foreseeable or that was not caused by us — for example loss caused by incorrect readings or entries, or by not following product instructions.
If you use the Service for business purposes, then to the extent the law allows: we are not liable for indirect or consequential loss, loss of profit, revenue or business, or loss of data you could have downloaded; and our total liability for all claims arising in any 12-month period is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
12. Ending your account
Closing your account: in My profile → Delete my profile. The account is deleted 14 days later; until then you can sign in and restore it. If you do not want this waiting period, tick “Delete at once” (or choose “Delete now” on the screen shown while the deletion is pending): everything is then erased from our live systems within 24 hours and cannot be restored (database records also disappear from the hosting provider's backups within 30 days, see below; photos and files are not part of those backups). A request to erase your personal data under the GDPR does not have to wait 14 days: you can make it this way or by e-mail to info@pool-health.com, and we act on it without undue delay and at the latest within one month. Download any data you need first.
Inactive accounts: an Owner, Specialist or Business account that has not been used for 12 months (the app not opened by you or, for a Business, by anyone in your team) and is not paid up is deleted. We e-mail you 30 days and 7 days before; opening the app before the date keeps the account, and you can download your data until then.
Deleting a Specialist or Business account deletes its clients, pools, visits, photos and documents, and the logins of its team and of its clients (whose portal access ends). Deleting a Client or team-member account deletes only that login. If you must keep records yourself (for example invoices), download them before deletion.
Deleted database records disappear from the hosting provider's database backups within 30 days; photos and files are not part of these backups and are removed from storage when the account is deleted. Our own payment and accounting records are kept for as long as tax and accounting law requires. We may suspend or close an account that seriously breaks these Terms.
13. Changes to these Terms
We may update these Terms. We tell you about a material change by e-mail or in the app at least 30 days before it applies. If you do not agree, you can cancel before it applies; if the change is to your disadvantage, we refund any prepaid fees for the period after it applies. Where the law requires your consent, we ask for it. Small changes that do not reduce your rights (for example clarifications) apply when published. For a new version of the Data Processing Agreement we also ask you to confirm it in the app and record which version you confirmed and when.
14. Governing law and languages
These Terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus have jurisdiction, without taking away any rights you have as a consumer under the mandatory law of the country where you live.
Language: these Terms, the Privacy Policy and the Data Processing Agreement are available in English only, and the English text is the only binding one, in every language of the app. The app and its other texts are also shown in other languages (Russian, German, Greek, French, Spanish and others); these translations are made with the help of machine translation and may contain errors or unclear wording, and they are for convenience only. If you notice a mistake or something unclear, please write to us at info@pool-health.com and we will correct it. This does not take away any rights you have as a consumer under the mandatory law of the country where you live.
